New York State Department Of Motor Vehicles' Point System
Every violation of the New York Vehicle and Traffic Law is assigned a point value between 0-11 points by the commissioner of the New York State Department of Motor Vehicles (DMV). The point value assigned to such violation is added to your driving record upon receipt by the commissioner of a certificate of conviction. Administrative action - including suspension or revocation of your driver's license-can be taken by the commissioner based upon your point total.
Your current point total is based upon the number of points you have accumulated within the last eighteen months. You must be convicted of a moving violation before the points are added to your driving record. The date of violation is used to calculate your point total rather than the date of conviction. You do not accumulate points on your driving record for out-of-state violations except if the violation occurred in Ontario or Quebec.
The New York State Department of Motor Vehicles will charge you a driver's responsibility assessment of $100.00 per year for three years if you accumulate six points on your driving record within an 18 month period. The New York State Department of Motor Vehicle will charge you a driver's responsibility assessment of $25 per year for three years for each point you accumulate over six points on your driving record within a 18 month period.
You may be required to attend a driver improvement clinic if you accumulate between 7 and 10 points within an 18 -month period. The New York State Department of Motor Vehicles will suspend your driver's license if you accumulate 11 or more points on your driving record within an eighteen month period. Your insurance company has a different point system -than the New York State Department of Motor Vehicles -to determine your insurance premiums.
You can reduce your current point total by up to four points by taking a New York State Department of Motor Vehicles approved accident prevention course.There is no New York State Department of Motor Vehicle approved internet accident prevention courses. A mandatory suspension or revocation cannot be avoided by taking a New York State Department of Motor Vehicles approved accident prevention course. A New York State Department of Motor Vehicles approved accident prevention course will not save you from having to a pay driver's responsibility assessment.
