You must yield the right of way to any vehicle that has entered the highway from a different highway. If two vehicles traveling on two different highways arrive at an intersection at approximately the same time, the vehicle on the left must yield the right of way to the vehicle on the right. These rules change if one of the roads is controlled by a stop sign or a yield sign. When making a left turn at an intersection or into an alley, private road, or driveway you must yield the right of way to any vehicle approaching from the opposite direction which is within the intersection or so close as to constitute an immediate hazard. When approaching a yield sign you must slow down your vehicle to a sensible rate of speed given the existing conditions and if necessary stop at the yield line. If there is no yield line then you must stop your vehicle before entering the crosswalk. If there is no yield line or crosswalk then you must stop your vehicle at the point closest to the intersecting roadway where you can see traffic traveling on the intersecting roadway but without entering the intersection. You must also yield the right way to any pedestrian crossing the roadway on which you are traveling. A rebuttable presumption that you failed the yield the right of way is created if you come into contact with a pedestrian in the crosswalk or another vehicle in the intersection after passing a yield sign without stopping. 10. Failing To Exercise Due Care-VTL §1146:
You must use due care to avoid coming into contact with any bicyclist, pedestrian, or domestic animal upon the roadway. If necessary you must give warning by sounding your vehicle's horn. Domestic animals protected by this statute are limited to domesticated sheep, cattle and goats under the supervision and control of a pedestrian.
